Vibe mattress getting sued

Vibe mattresses can leak fiberglass even if their users never removed the cover or tampered with the mattress in any way. This Amazon’s choice mattress is described as a very comfortable bed for a good price by some. For others, it’s an uncomfortable, poor-quality bed that showed them what fiberglass is in the worst kind of way. With hundreds of people who experienced the fiberglass issue, it only makes sense that there would be a Vibe mattress lawsuit by now.

Is there a Vibe mattress lawsuit?

Currently, there isn’t a lawsuit against Vibe mattresses, that is, against Classic Brands, LLC, which is the company that produces and sells Vibe mattresses.

In 2020, there was a lawsuit against Classic Brands in California. A person sued them because the mattress caused her “personal injury”. The records aren’t publicly available, so we don’t know the outcome of this trial. Still, we can’t think of many ways in which a fiberglass-containing mattress can injure you unless it’s fiberglass-related.

Ever since the 1970s, all mattresses sold in America must contain some kind of fire retardant. The cheapest ones typically have fiberglass and so far, thousands of people have had fiberglass injuries caused by several companies – including Vibe, Nectar, and Zinus. There is currently a class-action lawsuit against Nectar over fiberglass contamination. Lawyers are gearing up to file a similar lawsuit against Ashley Furniture. Zinus is also being sued for similar reasons. Other brands were sued regarding business practices rather than materials used in their products.

Why do people think that there’s a lawsuit against Vibe?

There’s an increasing number of fiberglass injury and contamination reports for Vibe mattresses, as well as for other brands that have been and are causing the same type of problems to their users, with the Zinus mattress probably being among the most talked about in the media.

Apart from fiberglass issues, some consumers complain about premature sagging or other quality issues. This, however, is not a reason to sue a company. You can always request a return or a refund or simply get a new mattress.

Vibe mattresses are extremely cheap and are sold at Walmart, on Amazon, and on many other websites.

Fiberglass

Some of those who complained about this flame retardant noticed fiberglass shards under their beds. It’s easily noticeable when you shine a light under the bed – the bottom of the mattress looks sparkly as well as the carpet and any other objects under or around the bed. Some of these people never had any skin irritation, probably because the glass was only coming out at the bottom of the mattress.

Those who had a worse experience actually had fiberglass particles poking them through the bedding, causing a skin rash as well as nose, throat, eye, and lung irritation.

Fiberglass in a mattress

Now, the company does say that you shouldn’t remove the mattress’s cover, but the only reason this person opened it up was to find what was giving her and her family a bad irritation.

You can see the tiny “hairs” that stand up – well, that’s glass, and those super-fine fibers can poke through and end up everywhere, carried by air. Like any other thin glass, these fibers break easily so people end up with fine glass dust all over their bedrooms.

Unfortunately, many cheap memory foam mattresses contain fiberglass. Other memory foam beds may have chemical fire retardants, but even that’s not a good solution since they can be toxic. We recommend reading our guide to the best mattresses without fiberglass if you want to avoid this issue.

Sagging

A small number of complaints are about the Vibe mattress sagging, sometimes after only a month, and sometimes after a year or so. This is unacceptable for any mattress, and if you need to return it, you’ll have to go with the return policy of the seller (Amazon, for example). This is because Vibe mattresses aren’t sold through the company website so all the refunds and returns go through the third party that sold you the mattress.

A lot of people say that Vibe is a great mattress and claim that they comfortably sleep on it. For them, it’s an excellent choice for a great price. The Vibe mattress is not a firm mattress and its soft construction works great for many side sleepers.

Can mattress brands be sued for fiberglass contamination?

You can’t sue a brand itself, but you can sue the company whose mattress brand harmed you or contaminated your home.

You can sue even if you removed the mattress cover against the manufacturer’s recommendations and got your home contaminated with fiberglass. This is because they all fail to say that the cover can cause serious harm to you and your family and that it costs thousands to get professionally cleaned out of your house.

So far, there have been thousands of people injured by fiberglass that leaked everywhere.

In cases like this, it’s much easier to go after the company in a class action lawsuit than in an individual one. Class action lawsuits bundle up similar cases of many people together – so if there are 300 individuals, one lawyer or group of layers will represent all of them. And those individuals just need to wait for the end of the trial and for the check to arrive in their mailbox. Read our guide to the Purple mattress lawsuit for information about a similar case.

Some law firms, such as classaction.org, are collecting information on fiberglass injuries and preparing lawsuits that would cover all brands that produce mattresses with fiberglass that have injured people and contaminated their homes.

They urge everyone who was hurt by fiberglass from their mattress to contact them, report their case, and provide evidence of mattress purchase and injuries.

FAQs

How can I tell if my mattress has fiberglass?

Read the labels carefully – look for words like fiberglass, glass wool, silica, or glass fibers. Another red flag is a “don’t remove cover” tag anywhere on the mattress. They may explain it in misleading ways, such as “do not remove the cover in order to keep the mattress integrity”, but what that means is you’ll end up covered in glass shards. Finally, mattresses that fall into these three groups are more likely to contain fiberglass: it’s a memory foam mattress (or any other polyfoam-based mattress), it’s one of the cheap mattresses ($400 and under), and if it says “Made in China”.

Can you sue a mattress brand for fiberglass contamination?

Yes, you can. You can sue them as an individual or you can find a law firm that would do a class action lawsuit and save a lot of your time and money. You can sue for fiberglass contamination as well as for fiberglass injury.

What should I do after I find that fiberglass leaked out of my mattress?

The first thing is to bag the mattress and remove it from your home ASAP. You should stop using the contaminated room immediately and inspect other places in the house with a flashlight, looking for sparkly dust. If the leak has just occurred, you might only need to get rid of the mattress, box spring, bedding, and maybe the carpet. If the leak happened a long time ago and you’re just finding it out after you’ve been itchy for months, we’ve got bad news. You might need to completely replace most of your belongings as many other families did. Alternatively, you should go on a cleaning spree. Use a vacuum with a HEPA filter and vacuum carpets and all furniture several times. Use a wet mop or a wet cloth for other surfaces. As for clothes, wash and dry them many times. Bag anything that hasn’t been cleaned.

How can I prevent my mattress from leaking fiberglass?

If you have a fiberglass case around your mattress, don’t remove the cover or abuse the mattress (no jumping, for example). Unfortunately, covers are sometimes not thick enough to hold in particles that break off the fiberglass case, so they poke out. This doesn’t mean it’s your fault – there’s nothing you could have done about it. If the idea of fiberglass gives you nightmares, you might want to check out mattresses without fiberglass and start saving for one.

Conclusion

Vibe mattresses have earned thousands of positive reviews, but they have also caused serious irritations and home contamination to many due to fiberglass. There was one individual lawsuit against Classic Brands, and there might be a class action lawsuit in the future, but for now, Vibe mattresses continue being sold and loved by many. If you do have a Vibe mattress or any other mattress that contains fiberglass, you might want to go over and under your bed with a flashlight to check for any sparkling particles, just in case. Once your mattress leaks too much fiberglass and your entire home gets contaminated, it’s nearly impossible to remove the contaminant completely.
