Nectar has been the problematic kid of the mattress industry pretty much from the very beginning. From hundreds of bad reviews regarding customer service to the lawsuits after the company (repeatedly) made false claims about where its mattresses were produced. The cherry on top is being prepared as law firms are collecting claims about fiberglass injuries for a class-action Nectar mattress lawsuit.
Nectar Mattress False Made-in-USA Claims Lawsuit (Updated info for 2023)
Nectar claimed that their mattresses were designed and assembled in the USA. They advertised their mattresses as such and made a lot of profit selling their mattresses under these false claims for years.
Then in 2018, the Federal Trade Commission (FTC) went into these claims and discovered that Nectar wasn’t assembling them in the US, but rather in China.
The FTC issued an order prohibiting Nectar from “making unqualified U.S.-origin claims for mattresses or other products”. If they wanted to be able to claim that their products were made in the USA, they would have to prove it.
Nectar Repeats False Claims in 2021
To be precise, this time they weren’t claims from the Nectar company. In 2021, the FTC found that the Dreamcloud mattress was falsely advertised, stating that mattresses had “100% USA-made materials”. This was both misleading and untrue.
In case you didn’t know, Nectar and Dreamcloud are both owned by the same parent company, Resident Home LLC, owned by Ran Reske.
Since both frauds were committed under the same parent company and the same owner, the FTC this time ordered them to pay $753,000 to settle FTC charges.
Unlike the Avocado mattress lawsuit, this Nectar case isn’t about the materials in their mattress, but rather about their business practices.
The FTC also expanded the new order to all companies under Reske’s control. He didn’t learn his lesson with Nectar and he repeated it with Dreamcloud, so the FTC had to take a preventative step and simply ban him from making false or misleading claims for whatever business he was doing.
Why is Nectar Lying About Where Their Mattresses are Made?
Nectar knows that the “Made in the USA” label is a powerful one – it gives an impression of high quality, reliability, and durability. It also implies that a company isn’t focused on increasing profits by hurting the local economy, but rather that it helps develop it.
When you outsource production to a country with cheap labor such as China, your profit margins will be better. When you manufacture products in the US, you have higher expenses, but you’re creating job opportunities for fellow Americans.
For all these reasons, you’ll get thousands of Americans who want to buy a product just because it’s made here. Lots of them are more willing to pay extra to support the local businesses and some will even go as far as to buy an average product just because it’s American rather than to pick some better options.
With lots of mattresses being produced in China (and elsewhere in Asia), Nectar decided to beat them with the “Made in the USA” label, and to compete against real American-made, law-abiding brands with lower prices. This way they had an unfair advantage in competition against everyone using outright lies and repeating those lies even after being warned by the FTC.
So it’s not just some random haters on Reddit who don’t like the company, it’s only objective to view it as a dishonest and shady business.
Is It Possible to Make a Claim on Nectar’s Class-Action Lawsuit?
Yes, but not for their false made-in-US claims as that lawsuit has been settled.
You can file a claim if you’ve been injured by fiberglass in Nectar mattresses.
Classaction.org is one place to contact, or you can file a claim on the website of the law firm called Environmental Litigation Group, P.C.
The Environmental Litigation Group says that you can’t file a class-action lawsuit claim unless you meet the following eligibility criteria:
- you own a Nectar mattress that uses fiberglass as flame retardant
- you’ve removed the outer cover and fiberglass has contaminated your home and/or injured you
- you have evidence that you purchased the mattress
If the class-action lawsuit is successful, you’ll be able to get maximum compensation for the costs of the entire home cleanup, replacement of clothes, furniture, lost time at work, and many more costs that you’ve had due to the bad mattress.
Is There a Nectar Fiberglass Lawsuit?
Although Nectar mattresses do contain fiberglass and some people did get harmed by them, there hasn’t been a lawsuit against them for fiberglass exposure yet. But some law firms have been collecting claims by individuals as they prepare for a class-action lawsuit, similar to the Purple mattress powder lawsuit.
The biggest fiberglass exposure lawsuit that hit the media started after a Sacramento mother sued Zinus. She and her children (one of who is a baby) were exposed to fiberglass from the mattress, which gave them bad rashes. There were many other reports and now there’s a class-action lawsuit filed against Zinus.
Some law firms are now looking into other mattress manufacturers with fiberglass (see our Vibe mattress lawsuit article for more info) and inviting people to file a claim if they were exposed to fiberglass, if they had fiberglass injuries caused by a mattress, and if their belongings were contaminated with fiberglass.
Why no-one is suing Nectar for fiberglass contamination
So far, nobody is suing Nectar for fiberglass contamination or exposure probably because people still don’t know they can do it. As we said above, there are groups of attorneys waiting for claims of people who literally felt the dangers of fiberglass on their own skin and/or had home contamination issues. Other brands are being sued for fiberglass exposure. The Zinus mattress lawsuit and Ashley mattress lawsuit are two examples.
Fiberglass is a hazardous flame retardant and if your home gets contaminated, you may have to spend tens of thousands of dollars on a remediation company to remove the glass fiber shards and particles from all over your home. On top of that, you may need multiple visits to the doctor, and all your clothes might need replacement.
Fiberglass looks like fine hair or fur and is made of glass; US law requires all mattresses to have flame retardants. Cheap mattresses contain fiberglass as a fire retardant. It breaks super easy and once your bed cover breaks or you remove it for cleaning, you’ll get fiberglass shard dust released into the air instantly. Washing your clothes and vacuuming won’t help at all. Since the tiny particles are airborne, they get everywhere and you may end up with a bad rash, nose bleed, cough, and other symptoms. If you’re worried about these effects, we recommend getting a mattress without fiberglass instead.
We did find several people who complained online about getting a really bad rash from the mattress. They haven’t expressed any intention of suing Nectar, but that doesn’t mean they won’t in the future. It seems like Nectar is off the hook at the moment.
Is the fiberglass in Nectar mattresses safe?
With fiberglass placed inside of the outer cover, no, it’s not really the safest option. It all comes down to whether you’re lucky to get a mattress that doesn’t have fiberglass poking through and won’t contaminate your whole bedroom.
When you sleep on a Nectar mattress, you’re unfortunately very close to the fiberglass layer because they put fiberglass in the mattress cover, and not somewhere in the middle of the mattress.
After all, even if you don’t have an issue with a brand new mattress, you probably will once the materials get worn down from normal use, or once your kid jumps on it one too many times. The tiny glass shards can start coming out.
Nectar makes cheap mattresses and it failed to issue adequate warnings about the dangers of fiberglass exposure and the dangers of removing the cover. On their website, they say:
For bigger or deeper set stains, an upholstery or spot cleaner or cleaning device would work well but we do not recommend removing the mattress cover entirely as the underlying foam mattress layers may get damaged in the process. If you do remove the cover, we strongly advise against moving the mattress, adding any liquids or other environmental substances to it or in any way disturbing the foam layers if the cover is off. Removing the cover will also void all warranties. Keeping the cover intact will help protect the integrity of the mattress so that you may enjoy amazing sleep for years to come.
No mention of the dangerous fiberglass that can ruin your home and drain your wallet.
The scariest thing is that people sometimes don’t realize that their extremely irritating rash comes from the mattress. With time, their symptoms get worse and their pets and family members also suffer. Tiny shards of fiberglass get into their skin, eyes, nose, and lungs. They cause redness and rash. Fiberglass inside the respiratory system creates breathing difficulties, including coughing and wheezing.
And when they finally figure out that it was the mattress, it’s too late – there’s fiberglass inside their pillows, carpets, all over other furniture mixed with regular dust.
Has Nectar had any other legal issues?
Apart from false claims about the production and origin of materials on one hand, and the fiberglass injury class-action lawsuit that is being prepared on the other, there isn’t any other legal action or issues facing Nectar or its parent company, Resident Home LLC.
The number one Nectar complaint is about their customer support – they may be non-responsive and take too long to issue a refund or start a return process for the mattress.
Then there are those who complain about long waiting times for mattress delivery.
But more importantly, many customers said that their mattress was short-lived. They say that their mattresses sagged after a few months or a couple of years, with some stating that the mattress was uncomfortable from the very beginning.
Surprisingly enough, some buyers have had the opposite experience. They are satisfied with customer support and the quality of their mattresses. They report quality sleep and quick response from the company if they had any problems.

Was the Nectar lawsuit legitimate?
It was legitimate because a lot of consumers only bought their mattresses because they thought they were buying an American product. Nectar mattresses don’t really stand out with any features, so “Assembled in the USA” was one of their strongest selling points. Their profits came from the fact that they lied to many Americans who only wanted to support the local economy, but ended up with low-quality mattresses and a Chinese mattress.
Yes, since April 2022, there has been a recall for 700 Nectar Premier mattresses made in September 2021 because they don’t meet flammability standards. These mattresses are:
King-size mattresses that were manufactured on September 24, 2021, and
Queen-size mattresses that were manufactured on September 27, 2021.
The date of manufacture is printed on the white tag.
Yes, they are made in China and they have been produced there from the beginning. The company is based in the US and all of the mattress designs come from the US, but materials are from China and all assembly takes place in China.
Conclusion
Nectar and Dreamcloud’s parent company, Resident Home LLC has lied about where the mattresses were produced and they were caught on two occasions. After the second one, they had to pay a hefty fine and were prohibited from making any similar false origin claims. All of their mattresses are 100% made in China. In 2022, Nectar announced a recall of their King and Queen mattresses manufactured in September 2021, due to not meeting flammability standards. All mattresses in the US must have flame retardants; cheap mattresses usually contain fiberglass. This fire retardant is known to cause a number of health issues and safety hazards if it gets out of a mattress. At the moment, reports of injury from Nectar mattresses are piling up and we’ll soon see a class-action fiberglass mattress lawsuit.
