Those who want to take legal action must meet some eligibility criteria:

  • must have purchased one of the mattresses sold by Ashley Furniture,
  • fiberglass must have leaked and glass shards must have either caused home contamination or injury to them/their family members.

So far, we know for sure there have been such cases. Ashley has failed to provide adequate warnings about the fiberglass presence and the dangers of removing the zipped outer cover of the mattress.

Just one quick look at Amazon reviews is enough to find lots of warnings from Ashley mattress users who learned about fiberglass in Ashely mattresses the hard way.

This mattress has fiberglass all in it. The description does not mention any fiberglass. My pillows, comforter, sheets all have to be replaced!!!! I can’t believe they are still selling this product!!

This mattress contains fiberglass. This wasn’t disclosed and the mattress has a cover with a zipper making it seem as though it’s safe to remove it. It’s not.

What Were the Outcomes of The Cases Against Ashley Furniture?

We have yet to see how the fiberglass class action lawsuits are going to unfold, but let’s take a look at other cases against Ashley Furniture and what the outcomes of those were (if any).

Some of these lawsuits are against Ashley HomeStores, which could be just regular furniture stores that sell Ashley furniture.

Case: Aberl v. Ashley Furniture Industries, LLC et al. – class action lawsuit filed in 2022

Reason: Ashley Furniture allegedly tricks buyers into thinking they’re getting discount prices when the company actually uses fake “original” sale prices.

Court: US District Court for the Southern District of California.

Outcome: Case status still pending. Latest update: “ORDER Granting #6 Joint Motion to Extend Defendant Ashley Furniture Industries, LLC’s Time to Respond to Class Action Complaint. Defendant SHALL RESPOND to the Complaint on or before 7/11/2022.”

Case: Daniel Wolf v. South Brunswick Furniture Inc., d/b/a Ashley Furniture HomeStore, et al. – class action lawsuit filed in 2017

Reason: Ashley Furniture failed to deliver furniture to Mr. Wolf at the agreed time, which is why he was unable to live in his new apartment for two weeks, during which time he had to pay for rent and utilities.

Court: Superior Court of New Jersey, Middlesex County.

Outcome: Not published

Case: Pate v. Dufresne Spencer Group, LLC – filed in 2022

Reason: The family waited for furniture for weeks; the store kept hanging up on them or putting them on hold whenever they called. Then the store finally made some items available for pickup, making the family do a 370-mile round-trip, only to find some items damaged and some missing. The updated version of the claim includes the fact that the store canceled the missing couch, loveseat and chair, but failed to inform ACIMA, the financing company, so the family was charged for all items.

Court: US District Court for the Southern District of Texas

Outcome: Case status still pending. Latest update: “JOINT DISCOVERY/CASE MANAGEMENT PLAN by Dufresne Spencer Group, LLC, filed.”

Case: Sladjana Perisic v. Ashley Furniture Industries Inc. filed in 2016

Reason: Perisic claimed that Ashley was “falsely, deceptively or misleadingly promoted, marketed, advertised, and sold furniture with DuraBlend”. Her furniture had become severely damaged after only a couple of years of normal use.

Court: U.S. District Court for the Middle District of Florida

Outcome: Perisic didn’t win. “ORDER dismissing case without prejudice for lack of subject matter jurisdiction. The Clerk is directed to close the case and terminate any pending motions.”

Does Ashley mattress contain fiberglass?

Yes, Ashley Furniture mattresses contain fiberglass. They are cheap mattresses and the company saves money by using cheap products. The most affordable of flame retardants out there is the infamous fiberglass, and that’s exactly what Ashley uses in its memory foam and hybrid mattresses.

Is Ashley Furniture currently being sued?
